Contracts and Legal Obligations

Contracts are agreements that bind parties to a particular person or business partnership and create a legal obligation. (Cartwright, Fauvarque-Cosson, & Whittaker, 2016). The written documentation contains a set of terms that have been agreed upon by the parties, individuals with formal standing, or organizations, usually in order to carry out a task or fulfill an obligation. Eigen (2012) contends that even though these legal papers follow outdated operational models, the parties' signatures and names serve as a representation of their consent.

Breach of Contract: Donald Trump and Jose Andres

Frequently, parties or a party may not be able to comply with the contract's stipulated requirements. When parties are unable to fulfill the obligations spelled in the contract, standard parameters provide that the authorized individual or party or organization shall incur a liability and will have to pay damages or as otherwise spelled in the contract; a juncture referred to as a pact breach. While contracts have been in existence for a long time, there are a few well-known individuals and parties who have entered into agreements and either party faulted in fulfilling their part of the bargain. An example is a famous case in the united states involving the current president of the United States -Donald Trump and an acclaimed Chef – Jose Andres. Their lawyers, as reported by Washington Post (2017), have been battling a 2-year case in the courts following an alleged breach of contract suit filed by Donald Trump legal representatives.

Donald Trump and Jose Andres Case

Mr. Andres, who hails originally from Spain had agreed with the then presidential candidate to set up a high-ranking restaurant in Donald Trump’s hotel. The deal was hopefully going to make a kill for Donald Trump’s business, and the duo was motivated to roll the dice. Following Donald Trump’s unequivocal remarks against immigrants entering the united states in one of his campaign trails, chef Andres announced that he would not be proceeding with the plans. As Donald Trump’s legal team would have it, they filled a law suit against Chef Andres’ move. The chef felt that the outright attack against illegal immigrants from Mexico that mentioned that they were responsible for drugs, crime and rape did not sit well with his consciousness. Andres alleged that more than half of his clients were residents and citizens of Mexico and his staff was Hispanic.

The Legal Battle and Resolution

The legal team for President Trump sued the chef to a tune of $10 million. The chef’s legal team also countersued with $2 million less in comparison to Trump’s claim. While their initial contract was potentially going to lower the campaign ratings for Trump, he did not consider cooling his guns especially when their financial machinery is fully involved in funding the campaigns around the United States of America. As the long tussle drugged for months, Chef Andres reached out to Donald Trump with an Olive Branch requesting that they settle their differences and donate the money to charity, but the American president downplayed the move – as is his popular custom. Towards the middle of 2017, the duo however jointly reported that they had reached an agreement. In a press conference, Donald Trump’s son, who took over the leadership of the hotel said that he was happy to put everything behind them.

The Cost of Breaching Agreements

Breaching of agreements can cost an arm and a leg if one party fails to deliver on its required obligation. In this case, the Donald Trump and the celebrity chef reached an agreement before they each lost an arm and a leg.
