Students' Constitutional Freedoms and Rights

Students with disabilities are entitled to constitutional freedoms and rights under the Bill of Rights, as stated in the United States Constitution, much like adults with developmental impairments. The opportunity to participate in recreation and enjoy amusement on par with members of society who do not have developmental disabilities is one of the liberties that K-12 children are guaranteed under the Constitution (Bill of Rights, 2017).

Freedom to Make Decisions

Additionally, K-12 kids are free to make their own decisions about their future in education and in general, without interference from anyone else. The Constitution further provides that the K-12 students with developmental disabilities have the liberty to humane care, dignity, and privacy to the extent that they are free from neglect, exploitation, and sexual abuse (Bill of Rights, 2017).

Freedom of Movement and Education

Also, the students are afforded the liberty to free movement and accessible transportation. Besides, the Constitution sets out that persons with disabilities are free to access appropriate education in the public sector. As such, the students are at liberty to interact freely within the school environment without barriers to their academic freedom.

Equal Access and Communication

Moreover, the students at this level have the constitutional freedom to equal access and use of all the facilities and activities within the community. Thus, they are free to participate in all the appropriate programs regardless of their level of disability or chronological age. The constitution has further set forth that persons with disabilities, just like the students with disabilities in K-12, are free to engage in communication with any citizen and even those who provide them with services (Bill of Rights, 2017).

Protection and Representation

Since they have the liberty to be assigned legal representation, the students with disabilities are free from isolation, discrimination, or any chemical or physical harm.
